Hosting Terms & Conditions

Last updated: 27 April 2026

These Hosting Terms & Conditions govern the supply of hosting and related services by ANOMONIX LTD, trading as ANOMONIX:Stack ("ANOMONIX:Stack", "we", "us", or "our"), to the customer identified in the relevant order, invoice, account record, or subscription ("you" or "your").

By ordering, activating, renewing, accessing, or using any of our services, you agree to be bound by these Terms & Conditions, together with any documents expressly incorporated into them, including our Acceptable Use Policy, Refund Policy, Privacy Policy, and any applicable service-specific terms.

If you do not agree to these Terms & Conditions, you must not order or use our services.

1. Information About Us

ANOMONIX:Stack is the trading name of ANOMONIX LTD, a private limited company registered in England and Wales.

Where these Terms refer to "ANOMONIX:Stack", "ANOMONIX", "we", "us", or "our", they mean ANOMONIX LTD acting through the ANOMONIX:Stack brand.

For legal and company disclosure purposes, the website and order flow should show the registered company name, company number, registered office address, jurisdiction of registration, and the fact that the company is limited.

2. Scope of Services

We provide hosting and related digital infrastructure services, which may include, depending on your selected plan or order:

  • shared hosting
  • managed hosting
  • virtual private servers
  • domain registration and renewals
  • SSL certificates
  • DNS services
  • email hosting
  • website migration assistance
  • backups and restore tooling
  • account management and support features
  • any related services or add-ons listed on our website or in your account.

The exact services, limits, entitlements, billing cycle, storage, bandwidth, mailbox quotas, and included features are those stated on the applicable product page, order summary, invoice, or customer account area at the time of purchase, subject to any later agreed changes.

3. Contract Formation

A request to purchase or activate services from us constitutes an offer by you to buy those services.

A contract is formed only when we accept your order, provision the service, activate the account, confirm acceptance, or otherwise begin supplying the relevant service.

We may refuse any order, renewal, transfer, upgrade, or account application at our discretion, including where we reasonably believe that the order presents a fraud risk, legal risk, technical incompatibility, abuse risk, sanctions issue, reputational issue, or operational concern.

4. Eligibility and Authority

You confirm that:

  • you are legally capable of entering into a binding contract
  • all information you provide to us is accurate, complete, and kept up to date
  • if you act on behalf of a company, organisation, or other person, you have authority to bind that party to these Terms.

You are responsible for ensuring that your account details, billing details, legal contact details, and technical contacts remain current.

5. Customer Account and Security

You are responsible for all activity carried out through your account, login credentials, control panel, API keys, or associated systems, unless caused by our own fault.

You must:

  • keep credentials confidential
  • use strong passwords and, where available, security controls such as multi-factor authentication
  • promptly notify us of any suspected unauthorised access, credential compromise, fraud, or security incident
  • ensure that all authorised users under your account comply with these Terms.

We may suspend access, rotate credentials, restrict access, or take other protective action where reasonably necessary to protect you, us, other customers, or the platform.

6. Acceptable Use and Customer Conduct

Your use of the services must comply with all applicable laws and with our Acceptable Use Policy.

You must not use the services in a manner that is unlawful, fraudulent, abusive, harmful, misleading, defamatory, infringing, malicious, or likely to damage the security, stability, availability, performance, or reputation of our platform or any third party.

We may investigate actual, suspected, or reported misuse and may take enforcement action including restriction, suspension, removal, or termination of service.

7. Billing, Fees, and Payment

All fees for services are payable in advance unless we expressly agree otherwise in writing.

You agree to pay all charges associated with your services, including recurring subscription fees, renewal fees, setup fees, usage-based charges, add-ons, taxes where applicable, and any third-party pass-through costs properly incurred in providing your service.

Unless otherwise stated:

  • monthly services renew monthly
  • annual services renew annually
  • domain-related services renew on their applicable registration cycle
  • add-ons renew on the same billing basis as the underlying service or as otherwise specified.

If you provide a recurring payment method, you authorise us or our payment processor to collect renewal charges and any other properly due fees using that payment method.

We may suspend, restrict, refuse renewal of, or terminate services if payment is overdue, declined, reversed, disputed, or otherwise unpaid.

8. Pricing and Changes

We may update our pricing, plans, specifications, commercial terms, or included features from time to time.

Any price change for a renewing service will apply from the next renewal date unless otherwise required by law. Continued use or renewal of the relevant service after the new pricing takes effect constitutes acceptance of the updated price.

We are not obliged to provide any service at an incorrect price where the error is obvious, manifest, or reasonably identifiable as a mistake.

9. Renewals, Expiry, and Non-Payment

You are responsible for monitoring your renewal dates and ensuring that valid payment details remain available.

We may send reminders or renewal notices as a courtesy, but failure to receive a reminder does not remove your responsibility to maintain service continuity or renewal status.

If payment for renewal is not successfully collected:

  • we may suspend the service
  • we may restrict access to management features
  • the service may expire, be queued for deletion, or be permanently terminated
  • associated data, domains, DNS, websites, email, or configurations may become unavailable or be removed in accordance with our retention and lifecycle policies.

10. Suspension and Termination

We may suspend, restrict, or terminate all or part of your services immediately or with notice where reasonably necessary, including where:

  • you breach these Terms or any incorporated policy
  • payment is overdue or disputed
  • the service creates a security, abuse, spam, malware, legal, or operational risk
  • a regulator, court, law enforcement authority, payment provider, registry, or upstream provider requires action
  • continued provision of the service becomes commercially, legally, or technically impracticable.

You may cancel a service at any time through the cancellation method made available in your customer account or by another method we expressly accept for the relevant product.

Cancellation stops future renewals but does not automatically entitle you to a refund except where our Refund Policy or applicable law provides otherwise.

Unless immediate termination is requested or required, services normally remain active until the end of the paid billing period.

11. Refunds

Refunds, credits, and cancellation rights are governed by our Refund Policy and any mandatory rights that apply under law.

Unless otherwise stated in the Refund Policy or required by law:

  • partial-period refunds are not available
  • domain registrations, renewals, transfers, premium domains, third-party licences, usage charges, custom work, setup work, and similar non-recoverable costs are non-refundable once incurred or provisioned
  • services suspended or terminated for abuse, fraud, spam, unlawful activity, or breach of policy are not eligible for refund.

12. Service Availability and Maintenance

We aim to provide stable and reliable services, but we do not guarantee uninterrupted or error-free availability.

Planned maintenance, emergency maintenance, capacity events, upstream outages, software faults, security incidents, attacks, or events beyond our reasonable control may affect availability or performance.

We may carry out maintenance, upgrades, reconfigurations, migrations, patching, and security work at any time. Where reasonably practicable, we will provide notice for planned work that is likely to materially affect service availability.

13. Uptime and Service Levels

Any uptime target, service level, or availability statement applies only where expressly stated for the relevant product.

Unless a separate written SLA applies, uptime figures are targets only and do not create an automatic entitlement to compensation, credit, or refund.

Scheduled maintenance, emergency maintenance, customer-side issues, application-level faults, misuse, force majeure events, third-party failures, domain or DNS issues outside our control, and circumstances beyond our reasonable control are excluded from uptime calculations.

14. Backups and Data Responsibility

We may provide backups, snapshots, restore points, or backup tooling as part of certain services. Unless expressly stated otherwise, such backups are provided for operational resilience and disaster recovery purposes only.

You remain solely responsible for maintaining your own independent and current backups of all websites, databases, email, files, configurations, and other data.

We do not guarantee that any backup will exist, be complete, be recoverable, or be suitable for your business continuity needs.

We may define retention windows, backup frequencies, restore limits, or restore fees depending on service type, plan level, platform constraints, and operational policy.

15. Customer Data and Hosted Content

You retain ownership of your content and data.

You grant us a limited, non-exclusive right to host, transmit, copy, store, back up, scan, process, and otherwise handle your content to the extent reasonably necessary to provide, secure, maintain, improve, support, or migrate the services, to comply with law, and to enforce our agreements and policies.

You are solely responsible for:

  • the legality of your hosted content
  • the integrity, quality, and suitability of your applications and code
  • obtaining any necessary rights, permissions, notices, and consents
  • ensuring that your use of the services does not infringe third-party rights or violate law.

16. Domains and DNS

Where we provide domain registration, renewal, transfer, or DNS-related services:

  • availability of any domain is never guaranteed until registration is successfully completed
  • domain services are subject to the rules, policies, and technical requirements of the relevant registry, registrar, or naming authority
  • you are responsible for ensuring that the registration, use, renewal, and transfer of your domain names is lawful and does not infringe the rights of others
  • we may refuse, suspend, cancel, transfer-lock, or take other action in relation to a domain where required by law, registry rules, abuse handling obligations, verification processes, payment issues, or dispute procedures.

Where a domain is registered on your behalf, accurate registrant and contact information must be maintained at all times.

Failure to renew a domain in time may result in expiry, suspension, redemption fees, loss of the domain, or permanent deletion.

17. Email Services

Where email hosting is included:

  • mailbox quantities, storage, send limits, retention, filtering, forwarding, aliases, and archival features depend on the relevant plan
  • we may apply spam filtering, rate limits, authentication requirements, anti-abuse protections, and sending restrictions
  • we may suspend or restrict email functionality to protect platform reputation, deliverability, or network integrity
  • you are responsible for lawful mailing practices, recipient consent where required, mailing-list hygiene, mailbox security, and configuration of client devices.

We do not guarantee inbox placement, uninterrupted message delivery, or compatibility with every third-party mail client or receiving server.

18. Support

Support is provided in accordance with the service level, plan type, support scope, and communication methods we make available.

Unless expressly included, support does not include software development, application debugging, custom code repair, third-party design work, digital marketing, SEO, business consulting, or unrestricted systems administration.

We may limit, prioritise, or decline requests that fall outside normal support scope or that require paid professional services.

19. Third-Party Providers and Dependencies

Some services may rely on third-party vendors, registrars, data centres, certificate authorities, payment providers, software licensors, infrastructure suppliers, or telecommunications networks.

We are not responsible for delays, failures, incompatibilities, suspension decisions, or losses caused by third-party systems or policies beyond our reasonable control, although we may choose to assist with coordination where appropriate.

20. Service Changes and Platform Evolution

We may modify, improve, replace, reconfigure, or discontinue features, technologies, suppliers, interfaces, or operational methods where reasonably necessary for security, compliance, resilience, performance, or commercial reasons.

Where a change materially reduces a core paid service you are actively using, we will use reasonable efforts to provide notice or an alternative path where practicable.

21. Data Protection

Where we process personal data for our own business purposes, we do so in accordance with our Privacy Policy.

Where we process personal data on your behalf as part of providing hosting or related infrastructure services, we may act as a processor and you may act as controller in respect of that data. Professional hosting providers commonly separate those processor terms into a DPA or equivalent addendum.

22. Intellectual Property

We retain all intellectual property rights in our platform, infrastructure, tooling, documentation, systems, branding, and service materials, except for your own content and materials.

Nothing in these Terms transfers ownership of our intellectual property to you.

You must not copy, reverse engineer, decompile, resell, reproduce, or exploit any part of our services except as permitted by law or expressly authorised by us in writing.

23. Warranties and Disclaimers

We will provide the services with reasonable care and skill.

Except to the extent required by law, the services are provided on an "as is" and "as available" basis, and we do not warrant that the services will be uninterrupted, error-free, suitable for every purpose, immune from attack, or compatible with every application, integration, or workload.

You are responsible for determining whether the services are suitable for your intended use, compliance needs, security posture, and business requirements.

24. Limitation of Liability

Nothing in these Terms excludes or limits liability which cannot lawfully be excluded or limited.

Subject to that, and to the fullest extent permitted by law:

  • we are not liable for indirect, consequential, incidental, special, punitive, or exemplary loss
  • we are not liable for loss of profit, loss of revenue, loss of business, loss of anticipated savings, loss of goodwill, loss of opportunity, or loss or corruption of data
  • we are not liable for losses caused by customer acts or omissions, third-party failures, malware introduced by you or your users, insecure code, unsupported software, domain expiry, expired certificates, suspension for non-payment, or breach of policy
  • our total aggregate liability arising out of or in connection with the services shall not exceed the total fees paid by you to us for the affected service during the 12 months immediately preceding the event giving rise to the claim.

25. Indemnity

You agree to indemnify and keep indemnified ANOMONIX LTD against losses, liabilities, claims, damages, costs, and expenses arising out of or in connection with:

  • your use of the services
  • your content, websites, applications, domains, mail activity, or data
  • your breach of these Terms or incorporated policies
  • your infringement of any third-party rights
  • any unlawful or abusive activity carried out through your account or services.

26. Force Majeure

We are not liable for delay, interruption, failure, or non-performance caused by events beyond our reasonable control, including natural disasters, utility failures, labour disputes, war, terrorism, civil unrest, epidemics, sanctions, cyberattacks, upstream failures, governmental action, or telecommunications outages.

27. Third-Party Checkout, Payments, and Orders

Where a purchase is made through a third-party merchant of record, reseller, or payment provider, including Paddle where applicable, that provider may handle checkout, payment processing, applicable taxes, invoices/receipts, refunds, chargebacks, and payment-related buyer terms. ANOMONIX remains responsible for providing, managing, supporting, suspending, and enforcing access to the service after purchase.

28. Changes to These Terms

We may update these Terms & Conditions from time to time.

The latest version published by us will apply from its stated effective date. Continued use of the services after that date constitutes acceptance of the revised Terms, except where applicable law requires a different process.

29. Governing Law and Jurisdiction

These Terms & Conditions and any dispute or claim arising out of or in connection with them, their subject matter, or their formation shall be governed by the laws of England and Wales.

The courts of England and Wales shall have jurisdiction, except that consumers may retain the benefit of any mandatory legal rights available to them under applicable law.
